Terms and Conditions
RESERVATION: An agreement to the terms and conditions of this document and retainer fee are required to reserve the dates and times of the shoot. If the shoot is rescheduled, postponed, or cancelled; or if there is a breach of contract by the CLIENT, the retainer fee is non-refundable and shall be liquidated damages to Storyteller Photography.
SHOOTING TIME / ADDITIONS: The CLIENT agrees that punctuality is essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the shoot, shooting will still end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT.
RESPONSIBILITIES: Storyteller Photography is not responsible for compromised coverage due to causes beyond the control of the photographer including but not limited to lateness of the CLIENT, uncooperative children or family members, weather conditions, or restrictions of the locations. Storyteller Photography is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage.
In the unlikely event that the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the photographer, the photographer will be responsible for a reschedule or refund with the CLIENT.
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the photographer will be responsible for a reshoot or refund to the CLIENT.
MODEL RELEASE: The CLIENT hereby assigns Storyteller Photography the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.
CAPTURE AND DELIVERY: Storyteller Photography is not liable to deliver every image taken at the shoot. The determination of images delivered to the CLIENT is left to the discretion of the photographer.
POST-PRODUCTION AND EDITING: The final post-production and editing styles, effects, and overall look of the images are left to the discretion of the photographer
PAYMENT SCHEDULE: The non-refundable retainer fee is due at the time of booking your session. The remaining balance is payable in full prior to or the day of the shoot. Payments are accepted in the forms of PayPal, direct deposit, online invoice or payment through my online store. In the event the CLIENT fails to remit payment as specified, Storyteller Photography shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the shoot.
FINAL INFORMATION REGARDING DIGITAL FILES: All final images will be delivered to the CLIENT in JPEG format, under no circumstances will the photographer deliver RAW files to the CLIENT. Final galleries for most shoots will be ready for download within 2 weeks. Storyteller Photography is not to be held responsible for bad quality printing of images from labs not recommended by Storyteller Photography.
COPYRIGHT INFORMATION: All images taken by Storyteller Photography are subject to copyright. Images or digital files are not to be edited, changed, altered (including but not limited to social media filters), or cropped (unless automatically cropped while uploading to social media) by anyone other than Storyteller Photography. Images or digital files taken by Storyteller Photography are not to be sold or given away, for stock image purposes or submitted for contests/publications without prior written agreement between the photographer and the CLIENT.
COVID-19 SAFETY: In the event the CLIENT or photographer become sick with flu-like symptoms, the session will be re-scheduled until they have been cleared of COVID-19 and symptoms are gone. Hand sanitizer will also be available for the shoot.
ONLINE GALLERIES: Online galleries will be deleted from the website any time from 6 months after it being emailed to the CLIENT. Please download and back-up your images as soon as you can. If you require access to your gallery after it has been deleted, there will be a $100 fee to unarchive your gallery. Storyteller Photography does not back-up and store photos beyond 24 months past a shoot and holds no responsibility for photos not saved, backed-up or lost files once the gallery is no longer accessible online.
